Class Q Permitted Development: Agricultural Buildings to Dwellinghouses
Class Q of Schedule 2, Part 3 to the Town and Country Planning (General Permitted Development) (England) Order 2015 grants permitted development rights for the change of use of agricultural buildings to up to five dwellinghouses, subject to prior approval from the local planning authority. The rights were expanded by the Town and Country Planning (General Permitted Development) (England) (Amendment) (No. 2) Order 2024, which increased the cumulative floorspace cap from 865 sqm to 1,000 sqm and expanded the maximum dwelling size from 465 sqm to 465 sqm (unchanged) but clarified the treatment of 'smaller dwellings' (under 100 sqm) and 'larger dwellings' (100–465 sqm) in the permitted combination.
The agricultural unit must have been established on or before 20 March 2013 — the date on which the original Class Q rights were introduced. Buildings erected after this date, or buildings that were not part of an established agricultural unit (for example, storage buildings on a residential smallholding), are excluded. The LPA will require evidence that the building has a lawful agricultural use, typically demonstrated by historic business rates records, farm business tenancy agreements, or aerial photography showing agricultural activity.
The structural viability requirement is the aspect of Class Q most frequently contested at prior approval stage and on appeal. Class Q permits 'conversion' operations — the installation of new windows, doors, roofs, insulation, and services — but does not permit the rebuilding or replacement of structural elements.
